Mira Singh and Lalita Singh
The Commission has obtained a court order under section 46B of the Fair Trading Act ( the Act ) against Mira Singh and Lalita Singh who breached enforceable undertakings to no longer participate in the fire safety equipment industry. This follows a previous conviction for making false and/or misleading representations to small businesses in relation to fire extinguisher services. While Mr and Mrs Singh signed an undertaking in 2020 to no longer operate in the fire safety equipment industry, the Commission became aware that the couple have continued to operate in breach of their undertaking. This application was the first of its kind brought by the Commission in accordance with the prescribed process under the Act where a breach of undertakings needs to be followed by an application to have the undertakings being made an order of court. Any future breach by them of the undertakings now ordered by the Court may constitute contempt of court.
