Changes to the case register
As part of a drive to improve the consistency and transparency of our investigation work, we’re updating the way we use our case register.
Our case register is a publicly available tool used by the Commission to communicate activity in the following areas:
- Investigations into individuals or businesses for potential breaches of laws enforced by the Commission
- Applications for authorisation and clearance.
From now on, the case register will include some information about all our active investigations. The amount of information we will publish will depend on the nature of each case and what stage of investigation it is at. The information that appears on the case register will be everything we’re able to share at that stage of the investigation. At the end of the investigation, we may publish its outcome.
Our case register landing page makes it clear that an open investigation does not imply that the Commission will ultimately decide to bring enforcement proceedings. The existence of an investigation does not mean that there has been a breach of the laws we enforce, as only a court can make that determination.
When deciding what to investigate we consider a range of factors, including whether there is a reasonable basis to suspect that a breach of the laws we enforce may have occurred or be occurring, as well as our enforcement criteria and current priorities.
We are committed to being as transparent as we can about the work we are doing. As a regulator, we have a large toolkit. Part of our toolkit is education and information, and our case register is part of this. Through the considered release of information on the register we can raise awareness of the types of conduct we are investigating including, where appropriate, the industries and/or the parties involved. This update is part of an ongoing programme of improvement work across our investigatory processes. We want to ensure that we work in a manner that is efficient and consistent across the Commission and helps us achieve our regulatory objectives.
