The Commerce Act 1986 (Commerce Act) promotes competition in markets for the long-term benefit of consumers in New Zealand.
The Collaboration and Sustainability Guidelines (draft Guidelines) have been developed to assist businesses to understand when collaboration with competitors for sustainability objectives may raise competition issues under the Commerce Act. The Guidelines also include steps businesses can take to comply with the law. The guidance is aimed at collaboration between businesses who would usually be expected to compete.
We are issuing the draft Guidelines for public consultation. We are keen to receive feedback and comments on the draft Guidelines from interested parties. In your feedback you may want to consider the questions below:
Are these guidelines likely to improve your understanding of what to do when considering collaboration for sustainability purposes?
Is there anything you would like more guidance on?
Are there any specific examples or situations you would like more information on?
In your submission, please explain your response and provide recommendations for how we can improve the Guidelines.
You can read and download the draft Guidelines below.
We will publish non-confidential versions of the submissions on our website. Please advise us if your response includes confidential information and clearly highlight the confidential information in yellow.
Please email your feedback on the draft Guidelines to competition@comcom.govt.nz with the subject line: “Collaboration and Sustainability Guidelines” before 5pm on 23 August 2023.
