Reserved decision in Commission application for Viagogo injunction
Published05 Feb 2019
The Commerce Commission’s application was heard today for an interim injunction to prohibit statements by online ticket seller Viagogo which, the Commission alleges, are misleading to New Zealand consumers.
In the Auckland High Court Justice Patricia Courtney reserved her decision.
The application was without notice, meaning Viagogo was not formally served with papers. However, papers were made available to Viagogo and submissions were made on its behalf by its New Zealand counsel, MinterEllisonRuddWatts. Viagogo objected to the orders sought and indicated it would protest the jurisdiction of the Court.
The Commission’s Statement of Claim and application for interim injunction can be read here under the Documents tab.
The Commission will make no further comment at this time.
