Media coverageThe conference is open to the media.

However, if any interested parties present confidential information the room will be cleared while that information is being presented. Commission Members, Commission staff, the party making the submission and legal counsel for other parties will be permitted to stay.

There should be no live taping of presentations without permission from the Commission.

The Commission will not be able to comment on the application until it has considered all the information and made a final decision.

Interested parties may be interviewed, if they agree to be, during breaks at the conference.

Interested partiesThe list of interested parties attending the conference will be finalised on Monday September 11.

ProcessThe conference is not a hearing or a trial, the venue is being used simply because it is convenient and available at the required times.

Interested parties will present information to the Commission and may be asked questions by Commission Members or staff. There is no "cross examination" by interested parties.

Background

The Commerce Commission is considering Telecom's application for clearance of a proposal which would give Telecom a 25 percent shareholding in Sky Network Television.

Telecom wants to acquire a 49 percent interest in HKP Partnership of New Zealand, which owns 51 percent of Sky.

On August 21 the Commission issued a draft determination tentatively concluding that on the information then available to it, it would clear the proposal.

Interested parties were given until September 4 to make submissions on the draft determination. They will have further opportunity to comment at the conference.

A clearance is granted if the Commission is satisfied that a business acquisition would not lead to dominance being acquired or strengthened in any market.
