The Commerce Commission has not approved guidelines relating to "illegal commissions and kickbacks", to be released at the New Zealand Tourism Conference tomorrow.

Commission General Manager John Feil said that the Commission will examine how the guidelines are put into practice and may take action if it believes that the guidelines are a form of price fixing or breach the Commerce Act in any other way.

The Act prohibits competitors working together to agree on standard prices or parts of prices, including commission rates.

The Commission is concerned that claims that it has approved the guidelines have been made, and has explained its position to the Tourism Board.
