Ignoring two earlier Commerce Commission warnings led to a Feilding fish shop being prosecuted by the Commerce Commission and fined $845 (including costs) in the Palmerston North District Court today.

Commission Chairman Dr Alan Bollard said the Commission follows up warnings it issues and will prosecute businesses who ignore them.

A competitor had complained to the Commission that Bayview Enterprises Limited, which trades as Feilding Fisheries, was mislabelling a cheaper variety of fish as groper.

The Commission advised Feilding Fisheries that the Fair Trading Act prohibits false or misleading claims about goods or services and gave it information about fish varieties and how they should be labelled.

It warned the shop a second time, and following a third complaint took court action.
