The Commerce Commission announced today that its decision on Goodman Fielder Ltd's application for clearance to acquire the baking and milling assets of Defiance Mills Ltd will be made by 5pm, Monday, April 14.

Commission Chairman Dr Alan Bollard said that the Commission was to have released its decision tomorrow, but wants more time to consider all the relevant issues.

The Commerce Act prohibits business acquisitions that result in dominance being acquired or strengthened in any markets. The Commission will grant a clearance if it is satisfied that dominance is not acquired or strengthened.

The Commission must determine what are the relevant markets and how the acquisition, if it were to go ahead, would impact on competition in those markets.
